The Role of the ILC & VCLT in International Investment Law title
Since it was adopted in 1969, the Vienna Convention on the Law of Treaties (VCLT) has come to be widely regarded as one of the International Law Commission’s (ILC’s) greatest successes. Indeed, the VCLT’s drafting history reflects that the ILC sought to create an enduring set of provisions constituting a law of treaties – regardless of the specific features of the individual treaties to which such rules might come to be applied.

The Minister for Defence has referred to the parliament's Joint Standing Committee on Foreign Affairs Trade and Defence the question how Australia makes decisions to send service personnel into international armed conflict. The decision to go to war is arguably the most important decision any government can make. Yet it is the least regulated of any government decision. We have all observed the many hours of parliamentary debate and back room negotiation on controversial legislation.
AYBIL Highlights: An MH17 Roundtable Discussion title
The Australian Year Book of International Law (AYBIL) uniquely combines scholarly commentary with contributions from Australian government officials. Consistent with this mission, this event will highlight recent work published in the Year Book focussed on the legal implications of the downing of MH17 in 2014.
International Law in Public Debate title
In her book, International Law in Public Debate (Cambridge University Press, 2021), Madelaine argues that public debates in the language of international law have produced a popular form of international law that matters for international practice. In this seminar, Madelaine will give an account of her book’s argument, drawing on examples from the Australian public debates over the 2003 Iraq War and over Australia’s military intervention in Vietnam in 1965/66. Through this account, Madelaine re-wires traditional accounts of who gets to ‘speak’ international law.
