Biography

Ben is a PhD candidate at the ANU College of Law. Drawing on the insights of the legal realists and contemporary law and political economy scholars, his research explores how the High Court has influenced economic inequality. This involves a few lines of inquiry across a few different areas of law, including constitutional law, competition law and labour law (particularly as it relates to union power and employee bargaining power). At the theoretical level, the project offers a critique of (1) inattentiveness to the constitutive role of law in markets and the relations between market participants as well as (2) modern law and economics literature, which tends to neglect distributional issues and ignore important questions of power, justice and equality. More specifically, his project interrogates the High Court’s doctrine and underlying political economy commitments to determine the effect of a case or set of cases on economic inequality.

Before starting his PhD Ben was a criminal lawyer in Canberra (both prosecution and defence) in addition to doing some policy work with the Law Council of Australia. He has a BA (Philosophy & Classical Languages) from the University of Alberta, a JD from Bond University and an LLM from the Australian National University.
