Migration Law & Practice

The ANU College of Law is offering the Graduate
Certificate in Australian Migration Law and Practice. The Program
is open to lawyers and those without a legal background.
Graduates of the Graduate Certificate in Australian Migration Law &
Practice
are recognised by Australia's Migration Agents Registration Authority
as satisfying the knowledge and practice requirements for initial registration
as a migration agent.
Students graduating after 1 January 2008 from the will be
recognised as passing the Prescribed Examination when they achieve a minimum
of 50% score on each assessment item in each unit of study. Note that
if a student fails any item of assessment they may be eligible for a supplementary
exam.
Please note that only Australian Permanent Residents
and Citizens may become registered migration agents in Australia.

THE PROGRAM
Students are required to complete the following four compulsory courses
to successfully complete the Program:
Australian Migration Law and MARA
This introductory course must be undertaken first – alone or in conjunction
with the following course (Australia's Visa System). It introduces the Australian
legal system with a focus on the legal structure for the regulation of migration.
The context of migration regulation is studied with an emphasis on history.
The role of migration agents, the philosophy of their profession and their Code
of Conduct are examined. Skills in the interpretation and application of law
and ethics are developed.
Australia’s Visa System
The Australian migration system is based on having an appropriate visa to enter,
and remain in, Australia. Students will study the requirements for various visas,
how to apply for visas and alternative pathways to meet client needs.
Visa Compliance, Cancellation and Review
Key parts of the regulation of migration are the systems for achieving compliance,
imposing sanctions for breaches, refusing visas and providing for merits and
judicial review of decisions. This course develops skills in identifying the
requirements and procedures for responding to the regulatory framework. Students
learn to appraise pathways, determine strategies and formulate submissions.
Applied Migration Law and Practice
A successful migration agent needs not only technical skills but also practical
skills. These skills include information retrieval, research, consultancy, advocacy,
communication and personal and professional development. This course develops
such skills and the ability to plan, organise and deliver professional and effective
immigration services.

METHOD OF DELIVERY
Students have the option of choosing between on-line teaching
and face-to-face classes at various locations:
On-line teaching is available to students around Australia
on a full-time or part-time basis. No class attendance is required, but students
need to have unrestricted access to a computer and the internet. Each course
requires on-line contact with tutor and fellow-students plus private study.
Face-to-face classes* are offered in Sydney and Melbourne.
Classes are offered intensively, over a period of 2 weekends for each course.
Each course requires 26 contact class hours plus private study. Students have
the option of full-time or part-time study.

Melbourne - ANU
House, 52 Collins Street (ANU House is located in the city centre, close
to Flinders Street Station.)
Sydney - University of Technology Sydney, Haymarket
campus (The Haymarket campus is on the edge of the CBD.)

ASSESSMENT
A mix of assessment tasks to test competencies including
written assignments, knowledge quizzes, case studies and simulated client interview
and tribunal appearances will be used in the program.
To complete the Program, students are now required to achieve a result of at
least 50% in each piece of assessment in each of the 4 courses in the Program.
DURATION
Full-time students can complete the Program in a minimum of two sessions.
Part-time students can complete the Program in a minimum of four sessions.
FEES
The Program attracts upfront tuition fees of $2,100 per 6-unit
course (2008 fee for domestic students). The fee includes the MARA assessment
fee, but excludes course materials/texts. The courses within the Program are
6-unit courses.
Total Program cost for 2008 is $8,400 (four 6-unit courses totalling 24 units
for domestic students).
FEE-HELP
This is the Federal Government loan scheme. Students eligible for a FEE-HELP
loan must complete and submit a Request for FEE-HELP Assistance form on or before
the census date for their first course.

APPLICATION
Students must meet the ANU College of Law application requirements.
Applicants must hold at least a three-year Australian Bachelors degree or equivalent.
A strong pass degree or better is normally required for admission.
